General Terms and Conditions (GTC)

1. Scope and Contracting Parties
1.1 These GTC govern the contractual relationship between Weg mit Dem! (hereinafter “Provider”) and natural or legal persons (hereinafter “Customer”) for the collection, transport, and proper disposal of all types of waste in the Greater Zurich area.
1.2 Conflicting or deviating terms of the Customer are not recognized unless the Provider expressly agrees to them in writing.
2. Description of Services
2.1 The Provider collects waste, bulky items, recyclables, and similar goods from the Customer and delivers them to a legally compliant disposal or recycling facility.
2.2 Excluded are substances whose collection, transport, or disposal is prohibited by law (e.g., explosive or radioactive waste, narcotics, munitions).
2.3 Hazardous waste as defined by VVEA/VeVA (e.g., chemicals, paint, asbestos) is only accepted upon prior written agreement and in accordance with applicable special regulations.
3. Conclusion of Contract
3.1 A contract is concluded when the customer confirms at the offer provided by the Provider.
3.2 BY accepting the offer, the customer also confirms acceptance of the General Terms and Conditions (GTC)
4. Prices and Payment Terms
4.1 All prices are in Swiss francs (CHF), including VAT and all mandatory disposal fees, unless otherwise stated.
4.2 The flat-rate and surcharge prices (e.g., distance, floors, extra effort) listed on the website or discussed in the
offer/chat apply.
4.3 Payment is due immediately after service (collection) via cash, Twint, debit/credit card, or by invoice (10 calendar days payment term) if agreed.
4.4 In case of delay, the Customer owes 5% annual default interest plus CHF 10 per reminder notice.
5. Customer Obligations
5.1 The Customer ensures unrestricted access to the pickup location and provides a parking space for the transport vehicle.
5.2 The Customer declares the type, quantity/weight, and potential hazards of the waste completely and truthfully.
5.3 Failed pickups or additional effort due to false information will be charged based on actual effort, with a minimum of CHF 60.
6. Prohibited or Restricted Goods
6.1 The Provider is entitled to refuse goods that may not be transported or disposed of for legal, safety, or health reasons.
6.2 If the Customer hands over prohibited or misdeclared goods, they are fully liable for all resulting damages and costs.
7. Right of Withdrawal for Doorstep Sales
7.1 For contracts concluded at the Customer’s home or workplace with a value exceeding CHF 100, the Customer may
withdraw in writing within 14 days without stating reasons (Art. 40a ff. CO).
7.2 The right of withdrawal expires if the Provider has fully performed the service at the explicit request of the Customer.
7.3 If the Customer explicitly requests performance before the withdrawal period ends, they confirm that they waive the right of withdrawal once the service is fully performed and the items cannot be returned.
8. Execution of Collection
8.1 Collection windows (time slots) are indicative; reasonable delays do not entitle the Customer to cancel.
8.2 Risk and benefit transfer to the Provider upon pickup, except in cases involving prohibited or misdeclared goods.
9. Liability
9.1 The Provider is liable for proven damages up to the contract value, provided they were caused by gross negligence or intent.
9.2 Liability for slight negligence, loss of profit, or consequential damages is excluded to the extent permitted by law.
9.3 Statutory product liability and mandatory consumer protection laws remain unaffected.
10. Data Protection
10.1 The Provider processes personal data solely for contract execution, invoicing, accounting, and customer
communication in accordance with the Swiss Data Protection Act (DPA) as of 01.09.2023.
10.2 Data retention: 10 years for accounting-relevant data; pickup photos and chat logs are deleted after 12 months at the latest.

11. Changes to the GTC
The Provider may change these GTC at any time. Changes will be communicated appropriately. If the Customer does not object in writing within 30 days, the changes are deemed accepted.
12. Applicable Law and Jurisdiction
Swiss law applies. The exclusive place of jurisdiction is Zurich City, unless mandatory legal jurisdictions apply.
13. Severability Clause
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision will be replaced by a legally permissible regulation that most closely reflects the intended economic purpose.
